Statutory Consultation
Navitus Bay Wind Park is defined as a Nationally Significant Infrastructure Project (NSIP) under the Planning Act 2008 because, if it goes ahead, it will have a generating capacity of more than 100MW. The Government identifies NSIPs as large-scale facilities, providing vital public services whilst supporting the UK economy. As part of the NSIP process, Navitus Bay is consulting with a range of different groups.
Statutory consultation (Section 42 consultees)
As well as consulting with the local community, Navitus Bay has been working with a broad range of statutory consultees to discuss the potential impact of the wind park. These are also known as ‘Section 42’ consultees in reference to the relevant section of the Planning Act 2008.
The statutory consultees that we’ve been working with on the project include, but are not limited to:
- Local authorities along the south coast
- Maritime bodies such as the Maritime and Coastguard Agency and harbour commissioners
- Conservation bodies such as Natural England and English Heritage
- Regulatory bodies such as the Civil Aviation Authority and Environment Agency
- Local landowners along the onshore underground cable route
Preliminary Environmental Information 3 (PEI3)
The Project is an Environmental Impact Assessment (EIA) development for the purposes of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009. Accordingly, preliminary environmental information is being made available. Consultation on Preliminary Environmental Information 3 (PEI3) starts on Monday 2 September and ended on Friday 11 October. Community consultation (Section 47 consultees)
Since 2010 we’ve been carrying out consultation with the local community on our proposals. Under Section 47 of the Planning Act 2008, which provides guidance on how developers should consult on their NSIP projects, “community” means those who live or work in the vicinity of the project, including visitors and users of the area. Our consultation with the community will take place over four phases, the comments from which will be analysed and captured in a Consultation Report that will form part of the application for development consent submitted for Navitus Bay.
